I here present the current proposal for the new bylaws of the CLR.
Proposed Bylaws
I. PURPOSE
The Collegium Legis Romanae, henceforth called the Collegium, was created for the purpose of incentivizing and structuring the study and debate of ancient and current Roman Law, Regulations and Customs.
II. LEADERSHIP
A) Rectores - There shall be two Rectores governing the general administration of the Collegium.
i) Each Rector shall have veto power over the decision of the other.
ii) Rectores may make Decreta (sing. Decretum) that have regulatory force beneath the Bylaws of the Collegium.
a) A Decretum loses its effect by the end of the decreeing Rector's term or by the stipulated end-date defined inside said term; a Decretum may, however, be renewed by another Rector.
iii) Each Rector is elected for a term of 2 (two) years.
iv) The office of the Rectores is collectively known as the Rectura.
v) The Rectores are automaticly granted the title of Magister Legum as soon as they assume office.
vi) For the term commencing L. Curtio L. Aurelio cos. (2017), the Rector elected with least votes will be given an exceptional term of 1 (one) year.
vii) If both Rectores recieved the same amount of votes, the one with the highest CID number will recieve the exceptional term.
viii) Subsections vi to viii of this section shall be deleted by the end of the aforementioned exceptional term.
III. MEMBERSHIP
A) Memership in the Collegium Legis Romanae is divided in two categories:
i) Collega - A regular member of the Collegium.
a) All collegae have the right to speak and vote in a Consilium of the Collegium.
b) All collegae have the right to summon a Consilium of the Collegium.
c) Any optimo iure citizen of the Roman Republic has the right to be a collega, unless dully expelled from the Collegium.
d) If a citizen loses optimo iure status, their membership in the Collegium shall be suspended until they have regained their status, unless they are dully expelled from the Collegium.
e) All collegae have the right to run for any elected position within the Collegium.
ii) Magister Legum - A collega considered to be knowledgable in Law.
a) A Magister Legum has the right to participate in any private forum discussion held inside the Collegium.
b) To become a Magister Legum, a collega must recieve a recomendation by the Rectura and be confirmed by a Consilium vote.
c) All rights ascribed to a regular collega are also valid for a Magister Legum.
IV. CONSILIA
A) A Consilium is a meeting of the Collegium.
i) The Consilia's decisions are defined through majority vote of the voting members unless stated otherwise in these Bylaws.
B) A Consilium can be held for the following reasons:
i) To propose an amendment to the Bylaws of the Collegium.
ii) To elect or depose an officer of the Collegium, as defined through these Bylaws or relative Decreta.
a) If an elected officer is deposed by a Consilium, a substitite officer must be elected afterwards with the adjective 'suffectus' to his title. This officer shall finish the term of the deposed officer.
iii) To expel a member from the Collegium.
a) The decision to expel a member can be revised by the Praetura of the Roman Republic or designated arbiters defined by them.
iv) To make a collective non-binding declaration to the Roman Republic or other institutions.
v) To dissolve the Collegium.
a) To dissolve the Collegium, there must be unanimous support of the voting members.
vi) To raise a collega to Magister Legum, in accordance with the terms of these Bylaws.
C) The Consilia shall be chaired by one of the two Rectores in a manner agreed by both.
i) If they cannot come to an agreement, the Consilia shall be chaired alternatively by one or the other, starting from the Rector with the lowest CID number.
D) The protocol governing the procedings of the Consilia shall be defined either by custom or by Decreta.
i) If the procedures are considered unjust, the Praetura reserves the right to enforce alteration without the need of making an Edictum.
V. CONFLICT RESOLUTION
A) Members of the Collegium are encouraged to resolve their conflict among themselves.
i) If they are unwilling or incapable of resolving their conflict alone, they may ask an agreed upon officer of the Collegium to arbitrate.
a) The decision taken by said officer is binding.
VI. TREASURY
A) The Treasury of the Collegium is to be managed by the Rectura or by an officer defined through Decretum.
i) Ultimate responsibility over the Treasury falls on the Rectura.
B) The transfer, use or investment of Denarii in the Treasury of the Collegium must be in line with the purpose of the Collegium defined on Article I.
C) In case of the dissolution of the Collegium, all Denarii shall be sent to the Senate Treasury.
VII. PATRES
A) In recognition of their efforts in founding the Collegium, citizens C. Cassia Longina and L. Aurelius Curio shall recieve the symbolic honorary title of Mater and Pater respectfully and should be addressed as such in any official documents of the Collegium.
If anyone wishes to change anything, please say so now. If not, you may vote on it now. Voting may be:
VTI ROGAS - Aye
ABSTINEO - Abstain
ANTIQVO - Ney
The lack of an answer will be computed as Abstineo.
If the votes gain the majority of the total members of the Collegium I will close the vote immediately, if not the debate and voting phase will last till the 11th of February.
